- Depending on where you are located 5 – 25 business days are estimated from date of order to receival.
- Once an order has been placed and made, Argo is unable to process a refund or swap as each case is made upon order and cannot be resold. ( Please triple check you have selected your correct phone size!!! )
Terms and Conditions of Sale (Terms)
2.1 Any Purchase Orders placed with Argo & Co:
(a) are subject to acceptance by Argo & Co; and
(b) constitute an acceptance of these Terms.
2.2 No Purchase Order, sales agreement or other agreement:
(a) will bind Argo & Co, unless accepted (in its absolute discretion) by Argo & Co; and
(b) may be cancelled without Argo & Co’s written consent.
- Prices
3.1 The prices charged for the Products shall be those listed on the Site and agreed to and acknowledged
by Argo & Co in its sole discretion upon acceptance of a Purchase Order.
3.2 Unless otherwise specified, prices are in Australian Dollars (AUD).
3.3 If goods and services tax or any similar tax (GST) has application to any supply made under these
Terms, Argo & Co may, in addition to any amounts payable in accordance with these Terms, recover
from the Customer an additional amount on behalf of GST, such amount to be calculated by
multiplying the amount payable by the Customer for that supply by the prevailing GST rate.
- Delivery
4.1 The Customer will be responsible for all costs of delivery of the Products.
4.2 Any date for delivery of the Products provided by Argo & Co is an estimate only and Argo & Co is not
liable for any loss or damage incurred by the Customer for late delivery of the Products.
- Delay
5.1 Argo & Co shall have no liability for delay, failure, or refusal to accept Customer’s Purchase Orders or
to ship products to Customer if the delay, failure, or refusal results from:

(a) capacity restraints;
(b) demand in excess of available supply;
(c) labour strikes or lockouts; or
(d) any cause beyond Argo & Co’s control.
- Acceptance of Product
6.1 The Customer shall inspect the purchased Product within (4) Days of delivery.
6.2 The Customer shall be deemed to have accepted all Products and that the Products are not faulty and
accord with the Customer’s Purchase Order unless the Customer notifies Argo & Co in writing
(including a photograph of any fault or damage) during such (4) day period.
6.3 The Customer acknowledges that it will promptly provide any evidence reasonably requested by Argo
& Co to support any claim relating to a faulty Product.
6.4 Argo & Co will not accept a return or be liable to accept a return of a Product which has been
manufactured for a custom Purchase Order or manufactured using the Customer’s specifications
(unless the Product is determined by Argo & Co to be defective in manufacture or materials).
6.5 Customers are not entitled to a refund or replacement if the Customer changes their mind about the
purchase of a Product.

8. Acknowledgement of Risks8.1 The Customer acknowledges and agrees that:(a) the way in which the Customer’s device displays the colour, size and shape of Argo & Co’s designs and models may differ from than the actual Product which is delivered;(b) the Customer will not rely on the Products for any purpose other than what it was designed for, which is for its aesthetic appeal;(c) the delicate nature of the designs and models of the Products is such that there is risk of damage to the Products while in transit or should the Customer drop the Products once received;(d) Argo & Co will be responsible for any damage or otherwise in respect of the Products prior to dispatch of the Products to the Customer;(e) from the time of dispatch from Argo & Co’s premises and until delivery, the risk of any loss or damage to or deterioration of the Products for whatever cause shall be borne by the Customer; and(f) upon Argo & Co providing the Customer with the relevant dispatch information, the Customer releases Argo & Co from any claim relating to the delivery of the Products.8.2 The Customer further acknowledges that it is responsible for making enquiries with any third party carrier with respect to the delivery of the Products the delivery address specified by the Customer. If any Products are to be left outside the Customer’s chosen place of delivery, then such Products shall be left at the Customer’s risk. We are not liable for any lost packages from Australia Post.
- Warranties and Liability
9.1 These Terms do not attempt to exclude, restrict or modify the application of any applicable laws of the
Commonwealth State or Territory which cannot be excluded, restricted or modified.

9.2 If any applicable law or statute implies any terms or imposes any liability on Argo & Co that cannot be
lawfully excluded from these Terms:
(a) such term are included in, or as the case may require, such liability is not excluded
by, the terms of these Terms; and
(b) the liability of Argo & Co for a breach of such terms, or as the case may be, such
liability will be limited to the maximum extent permitted under such law or statute.
9.3 The Customer acknowledges and agrees that to the extent permitted by law, Argo & Co will not be
liable for, and the Customer releases Argo & Co in respect of any claim, loss, cost, damage or
expense (Claim) arising out of any act or omission of Argo & Co or its employees, officers or agents.
9.4 The parties agree that to the extent permitted by law any liability for a Claim against Argo & Co that
cannot be excluded will be limited to the lesser of:
(i) the re-supply or repair of defective Goods or Services (if applicable);
(ii) the cost of the re-supply or repair by a third party of the defective Goods or
Services in question (if applicable); or
(iii) the contract price of the original supply of the Goods or Services.
9.5 Notwithstanding any of the above, the parties agree that Argo & Co will under no circumstances be
liable to the Customer for any indirect or consequential loss, loss of income, profit or opportunity or for
any contingent, consequential direct/indirect special, or punitive damages arising out of or in
connection with these Terms, at law or in equity.
9.6 Argo & Co’s liability/obligations to honour any Claim under or in connection with these Terms do not
extend to rectification of defects, loss or damage which is caused or contributed to by use, storage or
operation of any part of the Products other than in accordance with guidelines or specifications
supplied by Argo & Co. Argo & Co will also not be liable for defects, loss, costs or damage arising out
of or in connection with:
(i) reasonable wear and tear;
(ii) the misuse, neglect, or wilful destruction of any part of the Products;
(iii) any damage caused by or to the Products as a result of continued use of any
part of the Products after a defect has been detected or ought to have been
detected; or
(iv) water damage (howsoever caused).
9.7 If any provision of these Terms is held to be unlawful, invalid, unenforceable or in conflict with any rule
of law, statute, ordinance or regulation, it is to be severed so that the validity and enforceability of the
remaining provisions are not affected.
9.8 Notwithstanding any of the above, the parties agree that Argo & Co will under no circumstances be
liable to the Customer for any indirect or consequential loss, including but not limited to loss of profits,
revenue, contracts, anticipated savings, data, goodwill or wasted expenditure, punitive damages
arising out of or in connection with these Terms, at law or in equity.
- Intellectual Property
10.1 Argo & Co owns all IP Rights in any Products provided by Argo & Co to the Customer.
10.2 Where Argo & Co has designed or created any Products for the Customer, then the copyright in any
designs or creation shall remain the property of Argo & Co.
10.3 Other than as allowed under the Copyright Act 1968 (Cth), the Customer agrees not to sell, reproduce,
adapt, distribute, transmit, reverse engineer, publish or create derivate works from any part of any

Products designed by Argo & Co (whether for the Customer or not) without Argo & Co’s prior written
consent (including, but not limited to any part of any design or layout of Products).
- Costs
11.1 The Customer agrees to pay all of Argo & Co’s costs, charges and expenses incurred due to the
Customer’s default of these Terms, including:
(a) Argo & Co’s administrative costs; and
(b) Argo & Co’s legal costs on the indemnity basis.
- General
12.1 If Argo & Co fails, at any time, to insist upon strict performance of any obligations under these Terms,
or if Argo & Co fails to exercise any rights or remedies under these Terms, this does not constitute a
waiver or concession of such rights or remedies and will not relieve the Customer from compliance
with these Terms.
12.2 A waiver by Argo & Co of any default will not constitute a waiver of any subsequent default.
12.3 No waiver by Argo & Co under the Agreement will be effective unless it is expressly stated to be a
waiver and is communicated to the Customer in writing.
12.4 If any provision of these Terms are held to be unlawful, invalid, unenforceable or in conflict with any
rule of law, statute, ordinance or regulation, it is to be severed so the validity and enforceability of the
remaining provisions are not effected.
12.5 The parties expressly agree that these Terms will be governed by and interpreted in accordance with
the laws of Queensland.
- Entire Agreement
13.1 Except to the extent set out in these Terms:
(a) these Terms constitutes the entire agreement between the parties with respect to its subject
matter and contains all the representations, undertakings, warranties, covenants,
agreements and deeds of the parties;
(b) these Terms supersedes all prior negotiations, contracts, arrangements, understandings,
agreements and deeds with respect to the subject matter of these Terms;
(c) there are no representations, undertakings, warranties, covenants or agreements or deeds
between the parties, express or implied, except as contained in these Terms.
All cases are handmade and one of a kind! They are designed and modelled based on this case you've selected, and since I'm using shells etc. that I have found & sourced myself, the design will be almost exactly what you see here, yet could be slightly different. This makes your case completely unique, and entirely yours! ( No 2 cases are the same! )
